These Terms & Conditions apply to your use of aussiemarts.com.au and to purchases made through AussieMart.

By using the AussieMart website, creating an account, or placing an order, you agree to these Terms & Conditions.

1. Products and fulfilment

AussieMart sources products from approved suppliers and fulfilment partners.

Some products may be dispatched directly to you from a supplier or fulfilment warehouse rather than from an AussieMart-operated warehouse.

Because AussieMart uses multiple suppliers and fulfilment partners:

  • products in the same order may be shipped separately;
  • parcels may arrive on different dates;
  • different carriers may be used;
  • different tracking numbers may be issued; and
  • products may originate from different warehouses.

The use of third-party suppliers or fulfilment partners does not reduce any rights you may have under Australian Consumer Law.

2. Product information

AussieMart takes reasonable steps to ensure product titles, descriptions, specifications, dimensions, images, prices and availability are accurate.

Product appearance may vary slightly because of:

  • photography;
  • screen settings;
  • supplier updates;
  • manufacturing changes; or
  • revised packaging.

Where a variation amounts to a failure to comply with a consumer guarantee, your rights under Australian Consumer Law remain unaffected.

3. Prices

Unless otherwise stated, prices are displayed in Australian dollars.

Where GST applies, consumer prices include GST unless clearly stated otherwise.

Shipping charges and other applicable charges will be displayed before you complete payment.

Prices may change before an order is accepted.

If a genuine and obvious pricing error occurs, AussieMart may contact you before fulfilment and offer you the option to:

  • pay the correct price; or
  • cancel the affected item and receive a refund.

4. Orders

Submitting an order does not guarantee acceptance or availability.

Orders may be subject to:

  • successful payment;
  • stock availability;
  • supplier availability;
  • delivery availability;
  • address verification; and
  • fraud or security checks.

If a product becomes unavailable or cannot be fulfilled, AussieMart may cancel the affected item and provide an appropriate refund.

5. Payments

Payment must be successfully authorised before an order proceeds to fulfilment.

Payment methods shown at checkout may include debit cards, credit cards and other payment methods made available by AussieMart.

AussieMart does not intentionally store complete payment-card numbers or card verification codes on its own application servers.

6. Order changes and cancellations

Please review your order details and delivery address carefully before placing your order.

If you need to change or cancel an order, contact AussieMart as soon as possible.

Once an order has entered supplier processing, fulfilment or dispatch, changes or cancellation may no longer be possible.

Nothing in this clause limits rights available under Australian Consumer Law.

7. Shipping and delivery

Shipping and delivery are governed by the AussieMart Shipping & Delivery Policy.

Delivery dates and timeframes are estimates unless expressly stated otherwise.

8. Returns, refunds and warranties

Returns, refunds, replacements and warranty claims are governed by the AussieMart Returns, Refunds & Warranty Policy.

Nothing in these Terms excludes, restricts or modifies any consumer right or guarantee that cannot lawfully be excluded.

9. Customer accounts

If you create an AussieMart account, you are responsible for:

  • keeping your login credentials secure;
  • providing accurate account information;
  • providing accurate delivery information; and
  • keeping your contact information current.

10. Fraud and misuse

AussieMart may suspend, review or cancel transactions where there are reasonable grounds to suspect:

  • fraudulent payment activity;
  • unauthorised account use;
  • identity misuse;
  • unlawful activity;
  • automated abuse; or
  • interference with website security.

11. Intellectual property

AussieMart branding, software, original website content and other proprietary materials are protected by applicable intellectual property laws.

Third-party product names, trademarks, images and other intellectual property remain the property of their respective owners.

12. Liability

Nothing in these Terms limits liability where Australian law does not permit such limitation.

To the extent permitted by law, AussieMart is not responsible for indirect or consequential losses that were not reasonably foreseeable.

13. Governing law

These Terms are governed by the laws of Queensland, Australia, together with applicable Commonwealth legislation.
